Over the past few weeks, federal agents have brutalized people on the streets of Minneapolis. No police necessity can explain their excessive use of force, which has shocked and disgusted fair-minded people across the political spectrum. In the absence of a federal administration willing to hold its agents accountable when they depart from civil norms, states need to impose liability and make court-ordered relief available. Today in the senate we filed “An Act relative to violations of the United States Constitution under color of law.“
This proposed act will ultimately be part of a larger package of measures responding to the recent events. Other measures in that package have already been filed in some form and we are filing this measure separately at this time to surface it for discussion. See the statement below from the Committee on Steering and Policy which further explains the procedural context.
The proposed act will fill a gap in civil rights protection. Excessive use of force by officers — persons acting “under color” of law — constitutes a violation of civil rights secured by the Fourth Amendment of the Constitution. Victims of unjustified official violence are often able to sue under a federal statute that dates back to the reconstruction era that followed the civil war. That statute, now known as §1983, allows law suits seeking redress for deprivations of constitutional rights by anyone acting under color of state law. §1983 targets agents acting under color of state law, because Congress was seeking to protect freed people from the depredations of racist officers in former slave states. It does not cover violations of rights by federal officers.
The proposed act tracks the language of §1983, but will create liability for violations of the United States Constitution by any officer acting under color of law — whether state or federal:
Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia or the United States, subjects or causes to be subjected, any citizen of the Commonwealth or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the United States Constitution, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, . . .
The proposed act applies equally to local, state, and federal officers. However, it has the effect of creating new liability only for federal officers. The proposed act will not alter the liability of state and local police officers, because they are already subject to liability for violations of the United States Constitution under §1983 and the proposed act will preserve all the defenses available to officers sued under §1983, including so-called “qualified immunity.” Qualified immunity protects officers from civil liability for action that “does not violate clearly established statutory or constitutional rights of which a reasonable person would have known.” However, qualified immunity offers no protection for officers using unreasonable force — it is well-established that the police may not use unreasonable force in typical circumstances. Like law suits under §1983, law suits under the new act may be brought in state or federal court, although they are likely to often be finally resolved in federal court. See Haywood v. Drown, 556 U.S. 729 (2009).
It is worth noting several limitations of the proposed act. First, it does not create liability for violations of the Massachusetts Constitution. Doing so might violate federal supremacy principles. Second, it does not create liability for violations of federal statutes. Congress, as it creates statutes, makes implicit or explicit decisions about whether and how to create liability for violations of those statutes; we in the state legislature cannot override those decisions. Third, the proposed act does not target immigration officers — it applies equally to all federal officers; it does not interfere with federal decisions about law enforcement priorities. For more discussion of the jurisprudence of similar laws, see Using State Law to Protect Federal Constitutional Rights: Some Questions and Answers About Converse-1983, 64 U. Colo. L. Rev. 159 (1993).
It is also worth noting that Massachusetts does already have a civil rights statute. That statute is very broad in the sense that it applies to private actors, not just officials. It also very broad in the sense that it applies to violations of rights secured by both the federal and state constitution and also by federal and state laws. However, it is limited to deprivation of rights through “threats, intimidation or coercion.” This phrase has been construed to exclude direct violations of civil rights, for example where the excessive use of force is the per se violation of rights. To violate our civil rights statute, the force has to be applied to accomplish a further purpose that would be a violation of rights, for example to discourage voting. See Longval vs. Commissioner of Correction, 404 Mass 325 (1989). Our proposed law, tracking federal §1983, will not have this limitation and so will be available to redress excessive use of force.

To that end the Senate President has directed the Senate Committee on Steering and Policy, which has been working over the past several months through the Response 2025 initiative to identify proposals offered by Senate colleagues and others that meet this directive. The committee has been focused on policies that are effective and within the ability of the Commonwealth of Massachusetts to enact.

Well done Senator! The continued oppression of people in our country is appalling. After thirteen years in the military, the recent actions of our federal government continue to offend and disappoint me.
As an immigrant myself (legal) and a long-time naturalized US citizen, I would like to know what measures the Massachusetts Legislation can and should be putting in place to penalize and discourage illegal immigrants, including those who benefit from taxpayer-funded subsidies and social benefits. Why is there no effort in that direction too?
For decades, starting with Ellis Island and before, legal immigrants have been allowed into the US upon ensuring they would not become public charge (they had to be sponsored, usually by family members). Nothing of that sort happens with illegal immigrants. Our social safety net cannot withstand unlimited illegal immigration — that should be clear to any thinking person. Nor can we provide enough housing supply for an ever increasing demand by low-income people.
Even President Obama was authorizing massive deportations of illegal immigrants – in the millions — but the press was keeping quiet about it back then. Ask yourself why there is a double standard and lack of cooperation by the state officials now.
Continuing to coddle unvetted illegal immigration is a betrayal of public trust by our elected officials – since they are supposed to protect US citizens’ interests, which includes responsible fiscal management and public safety among other issues, first and foremost.
This is the Cloward-Piven strategy plan in action. They are collapsing the system by overwhelming the system. They think they will have their utopia once the old system is destroyed.

Making ICE’s job more difficult makes our state’s relationship with the Federal Government more and more acrimonious, which doesn’t benefit us. Not everyone in Massachusetts is opposed to deportations of illegal immigrants – but we will all be paying the price for the policies emanating from Beacon Hill.
The violence in Minneapolis would not be happening if the state of Minnesota was assisting with deportations of illegal immigrants (as was happening across the country during the Obama administration), and if protesters were not aggressively getting in the way of ICE’s operations. ICE has not been harming peaceful protestors standing with signs on the sidelines and not approaching the agents. But other protesters have been getting very aggressive and engaging in illegal behaviors themselves. ICE agents have been physically injured, spat on, hit with bottles of frozen water, or plastic bags filled with urine. Their vehicles have been vandalized. Normal people don’t do such things. And those actions have led to the unfortunate consequences. So where is a Massachusetts law making it clear that assaulting immigration law enforcement agents is also illegal?

Related to this, what are the penalties for violating an oath to abide by a US or State constitution and what remedies have been applied in the past? I would like to know if immigration agents take such an oath and if their actions could be shown to violate their oaths. If so, how would they be prosecuted and would that be separate from enforcing §1983 or your SD.3677?

What action can actually be taken against a federal officer who violates a law like this? If the person can be identified, can local or state police make an arrest? If not, do we need the cooperation of federal officials to act?
The rub as I understand it, but maybe I’m wrong, is that it’s basically on you, the person who the feds just beat the crap out of and locked up for 6 months without cause, to find a lawyer and go after them. This just allows you to sue. It doesn’t create any criminal offenses, for which local or state police would *theoretically* be able to arrest for. This legislation takes away a barrier to suing a federal agent who violated your rights, but still leaves the burden of “obtaining justice” on the individual harmed. Good on paper, but practically useless.
1983 actions are a robust and heavily used remedy against police brutality. This new statute will serve in the same way.

People opposed to deportations of illegal immigrants are active on social media (and here), but the increasingly obvious public demand for immigration enforcement is a fact of life in all developed countries, even in the super-liberal European Union. We can argue about the methods that are being deployed, but being against effective immigration law enforcement amounts to being against your own country surviving as a sovereign nation.

All the current immigration enforcement is “effective” at is causing violence and chaos. Biden managed to deport more people without terrorizing children and innocent bystanders. The extreme tactics used by current ICE agents are unconstitutional, expensive, and ineffective.
The violence and chaos is caused by so-called sanctuary jurisdictions that refuse to turn over illegal aliens already in jail. This forces immigration enforcement into the streets and neighborhoods. That chaos and violence does not exist in jurisdictions that turn illegal alien criminals over to federal enforcement. Texas has many, many times the number of immigration-related detentions without the intentional chaos. The violence and chaos are conscious decisions made by the politicians in those non-compliant areas.
The statement “Biden managed to deport more people” is simply untrue – sheer misinformation. The reason we have a massive effort to deport illegal immigrants right now is because Biden let millions of them in – even provided flights and buses to distribute them across the country.

While not all protected assets are covered by active NOTAMs or advanced airspace measures, UAS operators should exercise heightened caution near any DoD, DHS, DOJ, DOE, or USCG facilities and mobile assets. Maybe somewhere in the legislation add higher levels of civil rights protection to those who are 65 and over or who are frail who get caught up in these street brawls.
Will State Police and large local departments such as Boston enforce trespassing against ICE? Plenty of videos of people demanding ICE leave businesses and property without warrants and them refusing. Will they not let ICE enter school property? Without police to at least tell them no this means little.
Thank God as Americans we have the right to protest lawfully. We do not have the right to impede law enforcement by harassment or throwing objects at them. All law breakers need to be arrested and prosecuted to the full extent of the law. Without the rule of law, we get chaos. Divide and conquer is taking place throughout the country. It’s alarming to see so many who are concerned about our country being destroyed by illegal immigrants are willing to ignore the crimes of hate and lack of decency displayed by our President. I’ve seen this film before. The villains take over ( whether it’s the home, neighborhood, school, business, country, whatever) and ride roughshod over everyone. The duly constituted leaders hold meetings and loudly express their condemnation of the usurpers. They pass resolutions. But real resistance to the criminal gang…. i.e., fighting back in self defense… would be illegal (irony of ironies!) or physically dangerous. Then Gary Cooper, Charles Bronson, Errol Flynn, John Wayne, Tom Hanks, Neo…choose your own hero… pops up out of nowhere. And bravely stands up to the baddies. Who are decisively defeated. Everyone cheers. Closing credits. Ahem! Sorry people, we aren’t in a Hollywood film. No one is going to save us. We have to organize various kinds of mass resistance to slow down and frustrate the invaders. Or make individual preparations to keep a very low profile and survive the bad times as best we can. Take your pick. Most of us will get through the coming ordeal, more or less intact. But a lot of us won’t. Some evil things will happen to many innocent people. Best case scenario: The fascists will get massively voted out of office in the midterms, and hordes of them will eventually end up behind bars. A lot more might be put away for safekeeping in the very same “detention centers” they’re preparing for us. (Another notable irony.) Worst case scenario: Trump will cancel or sabotage the midterms and the dictatorship will drag on for….who can say how long? The real powers behind the corrupt politicians and the obsequious bureaucrats might keep their stranglehold on the country for many years. These are uncharted waters and all predictions are speculative. Good luck, everyone. Keep in mind that future generations will judge us all by what we do, or don’t do, in these sad times.
“Protecting the civil tights of persons”. Boy that’s rich. The Democrats’ corruption is only out matched by their hypocrisy. The “progressives” may trust them today, but they will be burned by them just like the rest of us.
The Democrats buy and sell the peoples’ civil rights. For all intents and purposes the Second Amendment is fully infringed. Nullified. It’s not for “safety” it’s selling out Americans’ Constitutional protections for votes. Same with the First Amendment and protected classes and so called “hatespeech.” People should not say hateful things because society encourages learning right from wrong, not because it is illegal. The former, is a function of liberal Western values and the latter of totalitarian Eastern values. “Hatespeech” is an end run on the First Amendment, a corrupting, linguistically degenerate shield against criticism and a political cudgel. With respect to race, limits on speech do not bring dignity and a more perfect union, it protects and maintains the largess of a corrupt profit machine of welfare, dependency commerce and patronage, and labeling conservative notions of dignity as hate speech. It is the same dynamic with respect to identity ideologies shutting down heralds warning of the pseudoscience sustaining and profiting off the trans phenomenon. The left cries Nazi, but they the ones committing the assassinations, establishing leftist-only social media like Bluesky (and Universal Hub, though UH runs rings around DNC PR firms called “local news”) and fleeing from X.
