Litigation with the Trump Administration

Recently, I heard an encouraging briefing from Attorney General Campbell‘s senior litigators about the status of litigation with the Trump administration. The briefing covered a wide range of issues, but my main take away was that litigation in the federal courts is still meaningful. Reading the news, one might have the impression that the rule of the law is a thing of the past. However, in this briefing we learned that the Trump administration often loses in court. And, in the cases where our Attorney General has sued on behalf of the Commonwealth, when the administration has lost in court, it has followed court orders: Funds initially withheld have been released as ordered.

  1. This sounds good! A glimmer of hope, thank you. But it seems the administration loses in court a lot, and just does what it wants anyway. I hope the $3.012 billion saved is actually in our coffers.

    I expected it to be bad, but Trump has exceeded all my expectations of disaster. I just hope there is a chance to take back one part of Congress at the midterms, unless the Republicans can succeed in gerrymandering all the votes. Such a nightmare.

    1. 40% of New England vote Republican yet there is 0 representatives in the House. Massachusetts has not had a Republican in House in over 30 years. Complete and total control. Do you think gerrymandering is something Dems specialize in?

          1. Good idea. Provided the commissioners’ independence could be guaranteed. I personally would like such a commission to be composed mostly of utterly cynical individuals who deeply distrust the motives of the political class in both major parties. And who have a demonstrable track record of public statements or published work to prove it. If they clearly dislike both sides and don’t particularly care which one wins elections, they would have no obvious reason to favor one over the other in a redistricting scheme. But a token die-hard Republican and another token true-believer Democrat on the commission probably would be helpful…each could point to possible hidden partisan flaws, unfavorable to their own cause, in an otherwise innocent-looking plan for drawing district lines. Flaws so subtly Machiavellian that even the non-partisan cynics who initially roughed-out the scheme might not notice them. After all, the commissioners would want to draw upon the accumulated experience of all sorts of advisors and consultants to help them turn out a really good plan. What if some of those consultants are not quite as saintly and unbiased as their credentials would lead us to believe? Hence the wisdom of including a couple of seasoned battle-scarred veterans of the political wars on the redistricting commission. Hey…former poachers make the best game wardens. (Just joking. Of course no redistricting plan will bring the Republican party anywhere close to real power in Massachusetts anytime soon. The business community will perforce have to continue working through compliant Democrats.)

Yes, all the while the MA residents are struggling to pay their bills since everthing doubled in price for food, utilities, gas, etc while Biden and Democrats (or whoever was really in charge) was in the White House. However, I will point out that gas is half the price it was under Biden. the Republicans and Independent s voices are definitely purposely excluded by gerrymandering by Democrats in MA, and many other states. How can one-third of the Commonwealth be Red voters, but have not one seat of representation unless gerrymandered?

Go ahead, label us all Marxists or Antifa if it gives you satisfaction, but saying that Trump upholds the rule of law given the hundreds of court cases his administration is facing nationwide for violations of statute and constitutional law is simply and sadly incorrect.

      1. Most of the court cases have gone the administration’s way once it went to higher courts. Marxism has been taught in our schools and culture for a long time. But just as it failed to take traction in 60s, it will fail again.
        The Federal govt needs to get tough with these insurrectionist mayors and Governors who are encouraging violence. Time for arresting those who are trying to over throw our Federal govt.

I contacted this so-called representative months ago, around the time of the Tufts kidnapping, and he poo-pooed the whole thing, talking about how the court system was going to hold up, blahblahblah.     Conclusion — the entire federal govt is illegitimate. That leaves the state. Massachusetts is a great state. I hope that you will do what you can to salvage it. You are running unopposed, I assume? That’s a shame. Because We The People deserve to have someone representing us who understands and says that this is Wrong, Wrong, Wrong.

  4. Thank you for passing along that update, Will, it’s much appreciated. It’s important for funding approved already by Congress to be distributed. If Republicans want to change that in the future, they have the power to do that for the time being at least. But they should make those changes in the way our Constitution envisioned. Thanks to Attorney General Campbell for all her work.

Gee, do you think AG Campbell will represent the approx. 100,000 people in Massachusetts who have been defunded for SNAP and WIC for the remainder of the year, as well as all other Citizens denied Federal government functions due to the “No” votes by Senators Markey and Warren?   6. As I understand it, the Trump administration is withholding these funds because of Massachusetts “Sanctuary” policies and failure to cooperate with Federal authorities on immigration. So if Massachusetts stopped spending taxpayer money on illegal immigrants and followed federal immigration law, they’d save money, reduce crime, not spend taxpayer money on these lawsuits and then get the Federal funds.

    2. According to the Constitution, funds appropriated by congress cannot be withheld by whim. A tenet that this administration doesn’t understand or respect. They can’t just withhold SNAP funds because they want to. Besides, most SNAP recipients reside in red states. The republicans are shooting themselves in the foot & they won’t get away with trying to fool all of the people all of the time. Of course, there will always be some who will be.

If the Democrats would sign a clean resolution, which is just keeping the budget the same for now, while it would give them more time to negotiate the spending budget, the SNAP would be paid out. They also were given opportunity to sign single issue CR to apy military and air control but Democrats voted no. But no, the Democrats are playing games because they are holding out for the illegals (read pg 57 of the CR) to get their healthcare back again which the big beautiful bill took away, and all the other special pet projects that they want to spend your tax dollars that were taken away in the BB bill (like sending 13.4 million to zimbabwa for “civic engagement, 24.6 million on climate resilence in Honduras, 3.9 million LGBTQ “democracy grants” in the West Balkans, 2.9 million for the desert locus “risk reduction” in the Horn of Africa, and 2 million for “organizing for feminist democrat principles” in horn of Africa. The USDA and Trump executive action can be only taken to pay out SNAP for ” disaster relief”. They cannot pay for regular benefits, which by the way SNAP is paying a whole bunch of illegals too. Congress, specifically Democrats need to stop playing games.

      After over thirty of voting exclusively for Democrats and witnessing the DNC’s distain for the Constitution during the Obama and Biden regimes and the staged specter of the propped-up HRC and Harris campaigns I switched parties to now vote exclusively Republican starting this summer in time for the preliminary. Regrettably my reservations were not overcome the previous year, but nevertheless was elated last November at the spark of hope for America to claw back its exceptionalism and fortitude from those opposed to that very strength and virtue.

  10. Thanks for sharing info. The AG does a good job. New England elects moderate Republican governors or senators. Now Moderates are few and far between lately. Karoline Leavitt lost her Congressional election in NH, not a moderate.
    Immigrants, like in passed generations, are here to work, create a better life for future generations, and would like to be part of American culture. More would have applied for Amnesty under Reagan, but did not out of fear.

Lots of interesting things to do out there, too…watch the cows, listen to the roosters, apply to the Feds for a bailout when your crop goes roots-up during a flood or burns to a crisp in a drought.   13. Work to bring insurance rates down. Pass the clean CR and stop putting the squeeze on taxpayers to fund this welfare scheme. The Covid emergency is over. Democrats and Republicans are in the pocket of the insurance companies and healthcare industry to the point we can only talk about taxpayers subsidizing insurance companies via taxpayer funded robber premiums.
