Cape and Islands Public Radio (WCAI) is running an excellent clip from reporter Molly Connors.

Great example about use of non-competes in the hair-styling business; balanced discussion of issues.   The quote from me speaks to one-side of the issue, but the bill we have developed is intended to be balanced — see the other posts on this site.

      What about forcing non-competes to make a distinction between employees voluntarily leaving a company and employees who are laid off or fired? It seems to me that if a company terminates an employee, it’s fair to force them to also invalidate the employee’s non-compete.

      • We’ve talked a lot about doing that, but we don’t see a way that will be both clear and fair. For example, if someone is fired for willful disclosure of confidential information to a competitor, would it make sense that they should escape their non-compete? There are a million termination scenarios and we decided that we had to stay away from the issue.
